Bergenbos Conduct Rules
Rules laid down for the Body Corporate of the Sectional Title Complex known as Bergenbos, Erf 13, situated in the suburb of Faerie Glen, Pretoria, governed in terms of Section 10(2)b of the Sectional Titles Schemes Management Act, 2011, Annexure 2.
The Body Corporate has in terms of Section 10(2)b of the Sectional Titles Schemes Management Act, 2011 Annexure 2, the authority to prescribe Conduct Rules for the Sectional Title complex taking into account law and regulations. These Conduct Rules supersede all previous Conduct Rules and will henceforth apply as the Bergenbos Conduct Rules.
• All residents and their guests are subjected to the Conduct Rules and the concerned Act
• The Rules in terms of the concerned Act are enforceable
• Interpretation of the Rules must be in accordance with the legislation concerned
An owner or resident of a section shall not, without the consent in writing of the trustees, keep any pet, animal, reptile or bird in a section or on the common property, and such approval will not be withheld without good reason.
When granting such approval the trustees may prescribe any reasonable conditions, eg. that pets are not a nuisance to other residents, that dogs be on a leash when walking them or under full control of a person, and that they do not run around the complex without supervision.
The trustees may withdraw such approval in the event of any breach of any conditions prescribed in terms of sub-rule (2).
Aviaries, kennels or such-like accommodation for pets may only be kept inside the unit, the unit's courtyard or garage. Unhygienic conditions may not be created in inside areas.
Cats - As cats cannot be controlled and have become a nuisance to other residents, it was decided that the keeping of cats as pets be phased out by not granting permission for any new applications; that cats for which permission have been granted not be replaced by other cats, and that owners of cats must ensure that their cats are sterilized and supplied with a proper sandbox.
The removal of any excrement left by animals on the common property and inside gardens is the responsibility of the owners of the pets. The grass of inside gardens will not be cut should excrement of animals be lying on it.
Refuse and refuse bins may only be kept in the unit's courtyard. Refuse may, for removal thereof, on allocated days (public holidays excluded) before 08h00 be placed in plastic bags outside the unit's courtyard door. Refuse may not be placed outside the previous day. Only in cases where residents will not be at home the following day are they allowed to place their refuse outside, after dark, the evening before.
Refuse may not be handled contrary to the regulations of the City Council. (Broken glass should, for instance, be wrapped in a double layer of newspaper. Large cardboard boxes must be torn into small pieces and placed in a refuse bag).
Garden refuse may be placed in the central area which is provided therefore after it has been cut up or broken up and placed in a refuse bag.
Should residents of units or their servants take refuse directly to the refuse removal area, such refuse must be placed in the municipal containers provided therefore.
No owner or occupier shall park or stand any vehicle upon the common property, or permit or allow any vehicle to be parked or stood upon the common property, without the consent of the trustees in writing.
The trustees may cause to be removed or towed away, at the risk and expense of the owner of the vehicle, any vehicle parked, standing or abandoned on the common property without the trustees' consent.
Owners and occupiers of sections shall ensure that their vehicles, and the vehicles of their visitors and guests, do not drip oil or brake fluid on to the common property or in any way deface the common property.
No owner or occupier shall be permitted to dismantle or effect major repairs to any vehicle on any portion of the common property, an exclusive use area or in a section.
Notwithstanding the stipulations of 3(1), may residents or their visitors park only in the garage concerned or carport, or on the paving adjacent to the unit and/or on gravel parking areas with the understanding that such parking may not cause an obstruction to the flow of traffic.
No vehicle or motorcycle may be parked on the grass.
Commercial vehicles with a mass exceeding 5 000 kg may not be parked overnight on the common property.
Vehicles may only be washed on that section of the property mentioned in sub-paragraph 4, or on a temporary basis on the grass, but then only for the purposes of washing the car.
An owner or occupier of a section shall not mark, paint, drive nails or screws or the like into, or otherwise damage, or alter any part of the common property without first obtaining the written consent of the trustees.
Notwithstanding sub-rule (1), an owner or a person authorized by him may install
any locking device, safety gate, burglar bars or other safety device for the protection of his section; or
any screen or other device to prevent the entry of animals or insects;
air conditioning units, satellite dishes, TV antennas, solar heating systems and any attachment of any nature whatsoever on the outside of the buildings.
Provided that the trustees have first approved in writing the nature and design of the device and the manner of its installation.
The owner or occupier of a section used for residential purposes shall not place or do anything on any part of the common property, including balconies, patios, and gardens, which, in the discretion of the trustees, is aesthetically displeasing or undesirable when viewed from the outside of the section.
Owners must note that substantial changes and/or additions to the common property may only be approved with an Unanimous Decision of the members. However, where the change or addition is on an exclusive use area, permission may be granted by the trustees, provided that the trustees have first approved in writing the nature of the change or addition and the manner of its installation.
No owner or occupier of a section used for residential purposes, shall place any sign, notice, billboard or advertisement of any kind whatsoever on any part of the common property or of a section, so as to be visible from outside the section, without the written consent of the trustees first having been obtained.
An owner or occupier of a section shall not deposit, throw, or permit or allow to be deposited or thrown, on the common property any rubbish, including dirt, cigarette butts, food scraps or any other litter whatsoever.
An owner or occupier of a section shall not, without the consent in writing of the trustees, erect his own washing lines, nor hang any washing or laundry or any other items on any part of the building or the common property so as to be visible from outside the buildings or from any other sections.
Washing may only be hung out to dry in the courtyard and not in any part of a unit where it is visible to the general public or other residents.
Mats and carpets may not be hung over outside walls.
The body corporate does not accept responsibility for washing hung out to dry.
An owner or occupier shall not store any material, or do or permit or allow to be done, any other dangerous act in the building or on the common property which will or may increase the rate of the premium payable by the body corporate on any insurance policy.
All tenants and other persons granted rights of occupancy by any owner of the relevant unit are obliged to comply with these conduct rules, notwithstanding any provision to the contrary contained in any lease or any grant of rights of occupancy.
An owner must ensure that a copy of these conduct rules is incorporated in any lease of his/her unit.
An owner must advise the trustees in writing when he/she lets her unit and must supply the trustees of full details of the tenant(s)/occupier(s) of his/her unit when it is let and/or occupied, with inclusion of his/her name, postal address, cell phone and/or another contact telephone number.
The attention of owners is drawn to the stipulations of Management Rule 69, which stipulate as follows:
“69. The stipulations of these rules and of the conduct rules and the duties of an owner with regard to the use and occupation of sections and common property is binding on the owner of any section and any tenant or other occupier of any section, and it is the duty of the owner to ensure that the rules are obeyed by his/her tenant or occupier, including employees, visitors and any family member of the owner, tenant or occupier"
The body corporate eradicates the pests on the terrain.
The owners are responsible for the repair of the damage inside their units.
All the owners together as collective owners of the whole complex eradicate the pests when they invade units with the implication that the costs will be borne by the funds of the body corporate.
Security at units is first and foremost the responsibility of the owners and the tenants.
Under no circumstances may any person enter or leave the complex without first making sure that the entrance gate has closed completely before moving on. Residents must ensure that their visitors adhere to this rule and parents must ensure that their children adhere to the rule.
All users of the entrance control and intercom must ensure that the facilities are used in a responsible manner.
Remote controls and keys for the entrance gates may under no circumstances be handed to domestic workers and security firms for their use.
Caravans, boats and trailers may only be parked in garages or carports.
Bicycles, motorcycles, tricycles, roller skates, skate boards, quad bikes, go-karts ,etc. may not be left on any portion of the common property.
Motorbikes, bicycles, tricycles, quad bikes, skate boards, go-karts or roller skates may not ride on the lawns. Tricycles, quad bikes, go-karts, skate boards or roller skates may also not ride on the motor vehicle driveway.
No articles except motor vehicles, motor cycles, caravans, trailers and boats may be kept in open carport areas, except when the gates of the open carport are covered with the specifies shade net. Written approval from the trustees must be obtained before covering the gates with shade net.
The garage of a unit may not be used to live in.
For security and aesthetic reasons, garage doors and carport gates (or doors) must at all times be kept closed, except when residents are busy working inside.
Silence must be maintained between 14h00 and 16h00 on Sundays and daily from 22h00 to 07h00.
Motorcar hooters may not be used on the common property unnecessarily.
Motorcar engines may not be revved.
Radios, musical instruments, sound equipment and TV sets must not be used in such a manner that it disturbs residents in other areas.
Residents may not plant shrubs, etc. on the common property or place pot plants there without the written permission of the trustees. Gardening will be handled by persons authorized thereto by the trustees, unless specifically agreed to the contrary.
No trees or shrubs which pose a threat to the buildings, foundations, paving, water and electrical or telephone conduits, gutters, downpipes or drains will be allowed. No trees or shrubs on the common property may be pruned or cut down without the written approval of the trustees.
Trees or plants planted by a resident which cause damage must be removed by an owner and any damage caused therefrom must be repaired at the owner's expense where in the sole discretion of the trustees, such nuisance or damage is caused or if it is anticipated that it will be caused by such trees or plants. Should an owner neglect to carry out these instructions the Body Corporate will be entitled to take steps against the owner or to repair the damage itself and recover such costs from the owner.No trees or shrubs which pose a threat to the buildings, foundations, paving, water and electrical or telephone conduits, gutters, downpipes or drains will be allowed. No trees or shrubs on the common property may be pruned or cut down without the written approval of the trustees.
Private gardens must at all times be kept neat and be looked after.
Garden tools or other implements must be put away in the unit's garage or courtyard after use.
'Braai' equipment is only allowed in front of a unit while being used. After use it must be put away in the unit, courtyard or patio.
Ball games are only allowed in the central lawn areas on condition that the gardens and plants are not damaged and the ball games do not cause disturbance to the residents in the surrounding units.
Residents must supervise their children and the children of their guests, so that no damage is caused to the common property, or the property of the other residents and no disturbance is caused to the other residents. Children may, in particular not tamper with electricity switch boxes, plants, decorative nameplates, taps, fire hoses, outside lights, etc. or climb on top of the water tanks or roofs, climb in trees or ride on any of the entrance control gates, etc.
No hobbies or other activities which may cause disturbance to other residents or make a lot of noise, may be practised in the complex. The blowing of vuvuzelas or any similar blowing instruments is not allowed within the boundaries of the Bergenbos grounds. Firing crackers and any fireworks whatsoever within the boundaries of the Bergenbos grounds is prohibited.
Residents must ensure that their domestic worker/gardener do not loiter on the common property and that they do not stand and talk to the complex workers during working time and keep them out of their work.
The resident of a unit is responsible for the behaviour of his/her children or visitors, and must ensure that they obey all rules in terms of the law and these conduct rules.
No business or trade may be conducted on the common property, nor any activity which causes excessive traffic or nuisance, except services which are allowed in terms of the law.
Auctions or jumble sales may not be held in a unit or on the common property.
No advertisements or publicity material may be exhibited on the common property or be distributed without the written permission of the trustees.
The swimming pool and the surrounding fenced area is for the exclusive use of the residents. Guests must be accompanied by a resident when this facility is used. Discretion must be exercised by residents with regard to the number of guests, to ensure that the swimming pool area is not monopolised. The Trustees reserve the right to limit the use of this facility by guests.
An adult must exercise proper and effective supervision over children under 12 years of age.
No glass objects or bottles or the use of alcoholic refreshments are allowed in the swimming pool area. Care must be taken that the swimming pool and equipment are not damaged.
No pets, bicycles, motorcycles, tricycles, “go-karts”, skate boards, roller skates, etc.are allowed in the swimming pool area.
The only entrance to the swimming pool area is via the gate which is installed. The gate must at all times be properly closed.
No excessive noise may be made in the swimming pool area. Swimming is prohibited on all days between 21h00 and 06h00 and on Sundays also between 13h00 to 16h00.
No ball games are allowed in the swimming pool area.
No “braai” of any nature whatsoever may be held in the swimming pool area. (Fire is prohibited).
Residents and visitors moving about on the common property do so at their own risk.
The use of a garden hose connected to municipal water points is only allowed from separately metered water for which the residents pay.
Borehole water must be used sparingly on the times of the days as prescribed by the trustees. Residents must close their borehole water taps immediately after their watering turns.
No connection of borehole water supply pipes with municipal water supply pipes is allowed because it is in contravention of municipal regulations.
No irrigation systems, except micro mist, are allowed. Only one connection per borehole water tap may be used (except in the case of micro mist) and then only one connection with micro mist at a time, in other words, a garden hose may NOT be used at the same time as the micro mist.
Borehole water is a privilege and not a right and you are not allowed to use your neighbour's borehole water should your neighbour be away.
Damage to the borehole irrigation system by a resident or his/her visitor is for the account of the resident concerned.
Municipal water points for each unit are metered separately and are read by the factotum each month. Residents must settle their water accounts before the end of each month.
Permanent residence in units is limited to a maximum of 6 (six) persons per unit.
Continuous residence of 30 (thirty) days or longer will be considered permanent residence.
With prior written permission from the trustees, which permission may not be withheld without good reason, temporary residence may be extended for longer than 30 (thirty) days, subject to such conditions as the trustees in their sole discretion may consider necessary.
No cigarette ends, food, chicken or meat bones, sweet wrappers, garden refuse, stones or other objects may be placed on the common property.
The Common Property and garden areas must at all times be kept neat. Residents are responsible for their own inside garden (exclusive use area) and the garden on the outside of the unit or against the garden wall of the unit.
No petrol or diesel driven electricity generators may be used in the complex.
Gardeners and cleaners in the service of the Body Corporate may not be used by residents during official hours to do private work. Residents may not interfere with the duties of the gardeners or give them any orders.
No firearms or pellet guns may be fired on the Common Property. The use of “Catties” by residents or their visitors is forbidden. Archery is absolutely forbidden.
Should any damage of any nature whatsoever be caused to the Common Property by a resident, his family, his visitors or his animals, the resident or by default the owner, will be responsible to compensate the Bergenbos Body Corporate for the costs involved in the repairs of such damage.
